Joint Ventures and Business Relationships
We counsel and assist in the formation of joint ventures between health care entities. We are experienced in working with groups of organizations seeking to acquire and operate major medical equipment and implementing new health care services. We routinely structure contracts and other financial arrangements to ensure compliance with these various regulatory laws to help hospitals, physicians and other health care providers meet their business objectives.
Medical Boards, Licensing & Credentialing
We represent clients on matters relating to peer review investigations, credentialing issues and disciplinary investigations and actions, as well assist applicants obtain licenses to practice various health care professions before the various health care regulatory boards such as the Boards of Medicine, Osteopathic Medicine, Dentistry, Chiropractic, Podiatry and Nursing. Additionally, we counsel clients regarding the the various licensing regulations for health care clinics, ambulatory surgical centers, MRI and diagnostic imaging services, rehabilitation services and assisted living facilities and nursing homes.
We have a thorough understanding of contracting issues affecting health care provider's relationships with managed care organizations. As part of our services involving managed care, we negotiate medical directorships and other arrangements on behalf of physicians and other health care providers. Additionally, we advise providers on managed care contracts and related reimbursement agreements and models.
Medical Staff Matters, Bylaws and Peer Review
We advise hospitals, medical staffs, physicians and allied health care providers concerning the interpretation and compliance of their corporate and medical staff bylaws with accreditation guidelines, including the Joint Commission on Accreditation of Health Care Organizations ("JCAHO"), state requirements and the applicability of various anti-discrimination and antitrust laws. We routinely represent physicians and hospitals in matters including the credentialing of medical staff membership and privilege matters, including the application of the Health Care Quality Improvement Act of 1986 ("HCQIA") and Florida's peer review statutes.
Medicare, Medicaid and Third-Party Reimbursement
We frequently provide guidance and representation in payment disputes and appeals. We assist practitioners in interpreting reimbursement rules under federal and state programs and from other third-party payers. We advise clients on all facets of third-party contracts including negotiations, arbitration, appeals and litigation arising from contractual disputes and assist in seeking practical solutions to the inevitable disputes between providers and payers.
